Changes to the Section 106 Application and Process
The Michigan State Historic Preservation Office (SHPO) made changes to the procedures for initiating Section 106 consultation in Michigan in 2020.
Effective July 1, 2020 is the requirement that the identification of all historic properties, both archaeological and architectural, must be completed by individuals meeting the applicable federal qualifications.
Effective January 1, 2021, a series of revised mandatory application forms are required for Section 106 consultation in Michigan. These forms are available, below. Consultation opened after 1/1/2021 on any prior application forms will be returned without comment for resubmittal on the current form.
Consultation requests which do not meet the new requirements by the specified effective dates will be returned to the applicant, unreviewed, for resubmittal. The guidance and documents below describe the changes in more detail. In the second half of 2020, SHPO held virtual training webinars for both agency officials and Section 106 consultants.
